A death due to the negligence of another my occur as a result of a traffic accident, a defective product, a defective vehicle or other serious accident. Special statutes apply in the event of a wrongful death. In Montana, a wrongful death case must be filed within three years of the date of death.
In the event of wrongful death, compensation is calculated by a number of factors, including the victim’s life expectancy, pain, suffering, medical expenses, future lost income and intangibles such as grief and emotional distress.
